not murder his pregnant wife, laci and their unborn son. 22 years ago, he says she was still alive when he left their modesto home to go fishing in the san francisco bay. his attorney is from the los angeles innocence project's claiming that prosecutors failed to collect importance at important evidence, including witness testimony and dna. blood evidence from the burned out found near peterson's home around the time of his wife, laci is disappearance. his attorneys are requesting to retest blood samples from the match found in a burned van. the status loss county da opposing this motion saying there is no legal obligation to have the dna evidence over for testing. today, the district attorney saying in court that their quest for new talks have been made before and denied and he believes peterson is dragging out the case. the da goes on to say he is waiting are wanting to protect lacey's family from being put through more we do know that judge is expected make her ruling on dna evidence testing after the

conclusion of today's hearing will have much more on air. >> a lot for dot com reporting live in redwood. tiffany justice kron. 4 news. >> tiffany, thank you so much. happening right now, david de pap back in court today for the state trial for the attack on paul pelosi. one day after getting sentenced to 30 years in federal prison for that same attack, opening statements are set to start pap facing charges, including attempted murder, assault with a deadly weapon. elder abuse and residential burglary. prosecutors say the pap admitted that he broke into the san francisco home with the intent of holding former house speaker nancy pelosi hostage. that state trial is expected to last about 3 weeks. and east bay fathers now suing the city of pittsburgh, accusing the police department of using excessive force on him. well, he was suffering from a mental health crisis.

>> he >> was the federal lawsuit is tied to this incident captured on video in february of 2022. police body camera video shows officers using a battering ram and tear gas at a hampton inn hotel. this lawsuit states, ashton porter refused to leave his room because he picks experiencing a psychotic episode at the time. the lawsuit claims police aggressively forced him out of the room using tear gas, pepper spray and shooting him twice with rubber bullets. porter suffered significant injuries and in addition to the city of pittsburgh is also suing the individual police officers. he's this officer. here is ernesto rosco. he's the same officer who choked. humberto martinez and to death in 2016. that case led to pittsburgh settling a lawsuit for 7.3 million dollars. we have new details now after a

woman was found dead at a home in san jose. police say the woman and her suspected killer who is now in custody did know each other. police responded to reports of gunfire at a home on north 20th street near san jose high school around 6 monday night when they arrived. police say a man barricaded himself inside an after hours of negotiations. he did surrender. officers say they found a woman with a serious physical trauma and she did not survive. but her cause of death is under investigation. >> we're still trying go through the entire investigation, determined you know what occurred in what order? that's again, part of the puzzle that we're trying to put together. we just know that was one last life that we didn't a kids again are doing outstanding job trying to figure out what happened. what went down. do have the suspect in custody and we're just working together to make sure bring justice for the victim and her family. >> officers say the suspect also shot a man before police

forecast right now with a live look outside showing us what's happened in in walnut creek right there. it's really nice day outside. meteorologist kyla grogan in the weather center with what's there. it's a beautiful day in the neighborhood. and you know, we've got sunshine out of half moon bay. we've got sunshine all across the bay area, marine layer giving us a break today. everybody. >> as expected to compress and give us a little bit of a more of a boost of high pressure today. so temperatures already reflecting that warmth. as you can see. we are at 65 in downtown san francisco. 71 in san mateo and hayward. but check out antioch already at 79 degrees. and we're just past the noontime hour. 79 also in santa rosa, san jose. a little bit cooler there at 74, a little breezy, certainly out point raise about 20 miles per hour 14. if we look at san francisco and half moon bay where we're just looking live, a little breezy out there, 17 miles per hour. so obviously that's going to still be with us today. but high pressure is starting to be more in control as that low has started to

>> an update now to that big rig carrying about 40,000 pounds of strawberries that overturned causing a big jam on the ramp connecting highway 1, 0, 1, 80 in san jose. it has now been lifted up right? the big rig flipped around 3 o'clock this morning. crews worked to clear the area of all those strawberries and then they flipped the big rig over. no one was hurt. we are waiting now to hear when that connector ramp between northbound one-on-one and northbound 8.80, as well as northbound 8.80, in northbound 101, will be reopened. we do understand that is expected to happen at any time now will post those updates on our website kron 4 dot com. that's hard to see all those strawberries just. get smashed up. all right. a san francisco restaurant is having to delay its grand opening this week because of a break in the thieves took off with thousands of dollars worth of items in just one night. kron four's less. the good reports.

worry layer hanging out at the golden gate today, everybody. just some really nice blue skies out there and temperatures reflecting that. we're getting that sunshine going. so. >> as we take a look here, you can see we've got 60's and san francisco and oakland, but the 70's are well in place here, especially. take a look at santa rosa north bay right now. 79 degrees, obviously a little cooler to half moon bay, but we're going to get into the 60's were already at 59. so what's the difference between now in 24 hours ago? if you're in santa rosa at 10 degrees and we're close to it. many spots like knapp and fairfield. but even across the entire bay area, you can see we're up a few degrees from yesterday and it's all to do with high pressure, right? so we see the blue skies. we did have a little bit cloud cover down in southern california. still hanging on those clouds, but they started to clear out and we're just looking really good. so today my friends is the day to take the dog on the long walk. this is san mateo, your forecast looking at are some nice upper 70's as you roll through afternoon. that's a really perfect day in my opinion to go for a nice walk, a dog appreciate this kind of weather. so high pressure

obviously right here. and it is starting to be more large and in charge. so we're going continue to warm up as we get into thursday and hang on to it for friday. we will start to break this down as we get towards the weekend and we'll see a little bit of cooling, but nothing extreme. and it looks like on the other side of that, we've got some more warm temperatures next week. so take livermore's an example. here are the average high should be about 78 degrees today. we're looking out for some of those 80's to get up there tomorrow. a little bit warmer. you can see a high 89. so i mentioned we cool down a little on the weekend and there's the cool down, but still taking us in a seasonal temperatures. and by the time we get to next tuesday, could see those temps rocketing up yet again. so let's put it all together and take a look at this awfully sunny, nice forecast that we've got going on now. if you are inland, i do know that when we get into these next couple of days, if you're a person that, you know, doesn't have ac or you're sensitive to heat, you want to make sure taking care of yourself. we will see that cooling trend. as i mentioned into the weekend. still a pretty nice weekend out there, though. and then as we get into next week,

again, we will start to warm it on back to you. thank you. governor newsom now facing some criticism over proposed budget cuts that some say will hurt thousands of undocumented californians. >> who rely on in-home support services. our capitol correspondent eytan wallace has the story. >> well, the governor says he does not want to make these cuts but feels he has no other choice to help balance the budget. but advocates say they hope he reconsiders this program is a lifeline. my they panetta is talking about what's known as the state funded in-home supportive services program, also known as i h s s as the sounds the program helps pay for in-home assistance and care for eligible seniors. and california is living with disabilities, including my days legally blind mother developed. thanks to ihs s still receives funding allowing her daughter to take care of her day in and day out at their home in madera. >> i am her supporters. you know who cooks cleans and provides daily assistance. anything that you may need but

funding she receives from the state to help care for her mother could soon be no more. >> that's because governor gavin newsom is proposing to cut about 94 million dollars from this specific part of the ihs as program that funds in-home supportive services for about 2,500 undocumented californians, including a stella. if this program is taken away for undocumented recipients, it would be devastating news from many families because there isn't any other program like a justice. >> many undocumented recipients would be left without any other alternatives being too potential health crisis. others in the in-home supportive care industry voicing outrage over the proposed cuts. it is indefensible for governor newsom to eliminate services for population for no other reason. but for their immigration status. >> undocumented or not, we are all human beings who deserve health care. >> we have access regardless gration status for his part. governor newsom and his office have long said his proposed budget maintains the

administrative leave for her role in the ongoing pro-palestine demonstrations taking place on campus. that professor is that adviser to student activists on campus. and she says the school is trying to censor her kron four's. jeff moment reports. >> well, spring semester may be over. graduations happened and many students have already left campus, including many who were part of this encampment protesting the war in gaza. meantime, though, the events are not slowing down. a professor was suspended by the university over her role in the encampment. she tells me she's denying all of the allegation felt like gaslighting. >> to it felt disingenuous. doctors saying kills a professor at san jose state and the adviser to many activists, students on campus. she says the university put her on administrative leave. >> after she made a speech to students protesting the war in gaza for some reason, they think i'm directing the students, which i'm absolutely not. i'm i'm supporting the students kill shared with kron 4. the e-mails that san jose

state sen they say she encourage students to march to the campus and set up an encampment back when students will only hosting rallies. she is denying all of it saying her speech is only in support of what the students wanted to do. >> i really don't see. any evidence or any any any fact that they're showing me to say that i violated any policy whatsoever. according to the letter sent the doctor killed, she is suspended with pay for a maximum of 60 days. >> we reached out to san jose state and they told us they don't comment on personnel matters. i believe that their fat threatened by my exercise of my free speechrthink he'll says she's worried the school will try to extend her suspension so she can't talk to students next semester and mentally preparing for that possibility. as last time we were here on campus with several weeks ago, with many students here still protesting back then san jose state said it was working to decide what kind of punishment if any
